The Ministry Of Commerce Has Stepped Up Efforts To Crack Down On Online Shopping Infringements And The Manufacture And Sale Of Fake And Shoddy Commodities.

The provinces, autonomous regions, municipalities directly under the central government, municipalities directly under the central government and the Xinjiang production and Construction Corps, business, communications, public security, people's Bank, industrial and commercial, quality supervision, press and Publication (copyright), intellectual property department, Customs General Administration, Guangdong branch and all directly subordinate customs offices, and the inspection and Quarantine Bureaus:

First, local industry and commerce, communications, public security, people's Bank of the people's Bank, customs, quality inspection, press and Publication (copyright), intellectual property authority should actively carry out online inspection, and use various channels such as the Department's complaint and report telephone to collect the clues of infringement of intellectual property rights and the illegal and criminal cases of counterfeiting and selling fake and shoddy goods in the field of network shopping.

All localities should firmly identify a number of key cases in the field of online shopping. They should be supervised by the office of the special action leading group of the region, and establish a responsibility system for handling cases.

Two, businesses, communications, customs, industry and commerce, press and Publication (copyright), and intellectual property authorities should urge the online shopping platform to carry out self-examination and self correction immediately, especially in Zhejiang, Shanghai, Shenzhen and other places. It is imperative to immediately urge Taobao, eBay and pat net to carry out self inspection and self correction work, and strengthen the investigation and rectification work of suspected online sales of counterfeit and shoddy products, and ask the online shopping platform to report the handling of illegal online stores to the leading group offices of the national and provincial special operations weekly (see Table 1 for specific tables).

The departments of Commerce, industry and commerce, communications, press and Publication (copyright) and other departments that have serious infringement of intellectual property rights must strictly supervise the development of their health according to law, such as interviews, warnings, time limits for rectification, and so on.

Three, businesses, communications, customs, industry and commerce, press and Publication (copyright), and intellectual property rights departments should immediately supervise the online shopping platform to shoulder the responsibilities of market organizers, strengthen the construction of self-discipline mechanism, and take it as an important basis for assessing rewards and punishments.

The main contents include strict business operators and market access system for trading commodities, establishing trademark and patent inquiry system, adopting technical means to screen information infringing intellectual property rights, making and selling fake and shoddy commodities, perfecting the safeguard mechanism of information release, identity authentication, paction, payment, logistics, post sale service, dispute handling, advance compensation, process monitoring and so on, and establishing a daily 24 hour online inspection system, timely investigating hidden dangers, dealing with illegal activities, and finding timely, serious, and serious problems.

Business, communications, public security, people's Bank of China, customs, industry and commerce, quality inspection, press and Publication (copyright), intellectual property and other departments should expose a number of illegal enterprises and typical cases in the online shopping field through the press conference and current meeting, etc., and intensify the exposure to the key areas and shopping platforms with frequent cases. We should publicize the key cases through frequent forms, channels, newspapers and other media through the local media such as television, radio, newspapers, etc. to form a hot spot of action and enhance the public opinion offensive. This shows that we must crack down on our determination, demonstrate the effectiveness of the attack, deter criminals, guide consumption rationally, and reverse the rampant adverse situation of the infringement of intellectual property rights and the crime of counterfeiting and shoddy goods in the online shopping field. Four, we should co-ordinate the efforts of the leading group office of combating intellectual property rights and counterfeiting and shoddy products in various locality.

Five, the competent commercial departments in various localities should timely summarize the progress of the area's online shopping activities against the infringement of intellectual property rights and the manufacture and sale of counterfeit and shoddy commodities in accordance with the relevant requirements, the phased results and the investigation and handling of the cases, the main practices and experiences, and the typical cases. With the help of written materials and supplemented forms, the progress of local network shopping cases will be summarized and reported to the Ministry of Commerce before the end of every Friday (see Table 2, annex 2), and the monthly summary written materials will be reported on the 30 day before each month.

The competent departments of commerce should report to the Ministry of Commerce on the key infringement cases identified in the field of shopping in the region before April 29th, and incorporate the weekly summary of progress.
