Trademark Rights Concerning Foreign Affairs

According to the provisions of China's trademark law, the right to exclusive use of trademark by a foreign party is basically the same as that of our clients.

      1申請(qǐng)商標(biāo)注冊(cè)。即商標(biāo)注冊(cè)申請(qǐng)人按法律規(guī)定的條件向商標(biāo)局請(qǐng)求確認(rèn)商標(biāo)權(quán)。

      2初步審定，指商標(biāo)局對(duì)申請(qǐng)注冊(cè)的商標(biāo)是否符合商標(biāo)法規(guī)定的注冊(cè)條件加以審查。

      3公告。指經(jīng)過(guò)初步審定的商標(biāo)在商標(biāo)局編印的定期刊物《商標(biāo)公告》上進(jìn)行公告，征詢社會(huì)各方面的意見(jiàn)，協(xié)助商標(biāo)局進(jìn)行審查。我國(guó)對(duì)申請(qǐng)注冊(cè)的商標(biāo)在初步審定并公告時(shí)采用申請(qǐng)?jiān)谙鹊脑聪壬暾?qǐng)者獲得商標(biāo)權(quán)。

      4駁回申請(qǐng)。指在初步審定程序中，凡不符合商標(biāo)法的規(guī)定或者同他人在同一種商品或者類似商品上已經(jīng)注冊(cè)的或者初步審定的商標(biāo)相同或者近似，由商標(biāo)局駁回申請(qǐng)，不予公告。

      5異議。指申請(qǐng)人以外的任何人對(duì)于商標(biāo)局初步審定公告的商標(biāo)提出不應(yīng)予以核準(zhǔn)的意見(jiàn)，要求撤銷初審公告的提議。

The objection shall be lodged within 3 months from the date of the preliminary verification of the trademark notice, and the parties shall not approve the registration or disagree with the objection made by the trademark office.

      6核準(zhǔn)注冊(cè)。指對(duì)初步審定的商標(biāo)，自公告之日起 3個(gè)月內(nèi)無(wú)人提出異議，或者經(jīng)裁定異議不能成立，商標(biāo)局即予以核準(zhǔn)注冊(cè)，向申請(qǐng)人頒發(fā)商標(biāo)注冊(cè)證，并予以公告。

      至此，商標(biāo)注冊(cè)人取得商標(biāo)權(quán)。
