According to the news, in order to strengthen the quality supervision of medical materials export, according to the "import and Export Commodity Inspection Law of the People's Republic of China" and its implementing regulations, the General Administration of Customs has decided to implement export commodities inspection, such as "6307900010" and other medical materials under the customs commodity number (see Annex), which is commonly known as "legal inspection".

And this morning, The customs officially announced the Announcement No. fifty-third of the Customs General Administration on 2020. Since April 10th, export quality inspection has been carried out under 11 commodity codes.

The inspection of export commodities shall be carried out for medical materials under the customs commodity number such as "6307900010".

What is statutory inspection?

The entry exit inspection and quarantine institutions shall carry out inspection on the import and export commodities listed in the catalogue and other import and export commodities that are required to be inspected by the entry-exit inspection and quarantine institution in accordance with the laws and administrative regulations. At present, the entry exit inspection and Quarantine Bureau has been merged with the customs.

The legal inspection is that the regulatory requirements on the customs declaration form are A (import) or B (export) goods. When customs declaration is provided, the customs clearance must be provided by the Commodity Inspection Bureau, that is, statutory inspection of goods. If there is no A or B, it is not a statutory inspection of goods. No customs clearance is required during customs clearance.

That is, the goods that are subject to statutory inspection include: (1) the list of legal inspection; 2. Other import and export commodities that are required to be inspected by laws and administrative regulations.

Simply speaking, customs inspection will only pass the customs clearance certificate issued by the local entry exit inspection and Quarantine Bureau.

Legal basis

The law of the People's Republic of China on import and export commodity inspection

The fifteenth shippers or their agents that must be examined by the commodity inspection authorities in accordance with this Law shall report to the commodity inspection authorities for inspection within the time and place specified by the commodity inspection authorities. The commodity inspection authorities shall complete the inspection within the time limit stipulated by the State commodity inspection authorities and issue a certificate of inspection.

Regulations for the implementation of the import and Export Commodity Inspection Law of the People's Republic of China

The consignors of twenty-fourth statutory inspection export commodities shall, within the place and time limit stipulated by the General Administration of customs, submit the necessary documents and relevant approval documents to the entry exit inspection and quarantine organs for inspection. No export shall be allowed to be inspected or not inspected.

The export commodities should be inspected at the place where the goods are produced. The General Administration of Customs may designate other places for inspection according to the needs of facilitating foreign trade and import and export commodity inspection.

The shipper shall apply to the entry-exit inspection and quarantine institution for verification if the goods that have been verified and managed are exported. The entry exit inspection and quarantine organs shall carry out verification in accordance with the provisions of the General Administration of customs.

The law of the People's Republic of China on import and export commodity inspection

Thirty-third in violation of the provisions of this law, the import and export commodities that have to be inspected by the commodity inspection authorities must be sold or used without authorization, or if the export commodities that have to be inspected by the commodity inspection authorities have not been reported to be inspected and exported without authorization, the commodity inspection authorities shall confiscate the illegal gains and impose a fine of more than five percent or twenty percent of the value of the goods. The law shall be investigated for criminal responsibility.
