    On October 22 last (2015), the European Commission (EC) launched a public consultation to ban 291 harmful chemicals in clothing and other textiles in the future. This consultation will be conducted until January 22, 2016, as part of the simplified procedure for introducing restrictive measures under the Regulation on Registration, Evaluation, Authorization and Restriction of Chemicals (REACH Regulation).

    According to REACH regulations and its Annex XVII, the EU strictly limits the content of harmful chemicals in a variety of commonly used consumer goods. These consumer goods include toys, clothing, shoes, leather products and plastic products. Up to now, there are many chemicals subject to REACH regulations, including phthalates, azo dyes, cadmium, nickel, mercury and lead.

    The routine procedure for the introduction of restrictive measures in the EU is that the European Chemical Agency (ECHA) or member states prepare a detailed Annex XV Restriction Information Document, then conduct public consultation, listen to the opinions of the two committees of the European Chemical Agency, and finally decide by the European Commission.

    However, according to Article 68 (2) of REACH Regulation, the European Commission can adopt simplified procedures to introduce restrictive measures, mainly involving carcinogenic, mutagenic or reproductive hazardous substances (CMR) classified as Category 1A or 1B, regardless of whether these substances are used alone, in mixtures or in products used by consumers. Class 1A and 1B CMR substances are considered to be more hazardous substances, so the European Commission can recommend and adopt restrictive measures without following the above routine procedures.

    The European Commission intends to adopt simplified procedures to introduce restrictions on the content of CMR substances in specific consumer goods categories. Within this regulatory framework, textiles and clothing were listed as the first "trial cases" because consumers may have long-term or multiple short-term exposure to CMR substances in these two types of consumer goods.

    The restrictions that may be introduced in the future will cover the following products for consumer use: products that contain at least 80% textile fiber by weight, or whose components contain at least 80% textile fiber by weight, including unfinished, semi manufactured and finished products, whether or not coated or laminated. These products include clothing, shoes, accessories, interior textiles, fibers, yarns, cloth and fabric.

    The specific products that may be involved in the restrictive measures include underwear, pajamas, swimwear, clothing, neck scarves, ties, handkerchiefs, hats, gloves, socks, several shoes, indoor decorations and curtains, carpets and other floor coverings, table mats, tablecloths, towels, bed sheets and pillow covers. Products not subject to the supervision of restrictive measures include shoes, clothing or parts thereof and accessories made of genuine leather; Shoes, clothing or parts thereof and accessories made of natural fur or animal skins; And toys.

    Finally, when the procedure is completed, the list of controlled CMR substances (individual substances or groups) will be added to the specific appendix of Annex XVII of the current REACH regulation. Later, if necessary, the attachments can be updated regularly.

    The main purpose of this consultation is to collect information about the existence or possible existence of CMR substances in textiles and clothing, as well as the possible socio-economic impact of the introduction of restrictive measures. Other purposes include exploring the enforcement of restrictive measures, as well as collecting data on the concentration of substances used, their functions and whether substitutes are available.

    The European Commission, with the assistance of the European Chemical Agency and experts from member countries, has initially formulated a list of CMR substances (Category 1A or 1B). These CMR substances may at least exist in textiles and clothing for consumer use. The preliminary list can be found in the questionnaire (through the link to the consultation notice below). The Administration believes that it is necessary to consult the public in order to assess whether the restrictions introduced in the future are appropriate and enforceable.
