In December 27th last year, the finance and Economic Commission of the National People's Congress convened the first plenary session of the drafting group of e-commerce law, and officially launched the legislation on electronic commerce law. Lv Zushan, deputy director of the finance and Economic Commission of the NPC, said that from the drafting group to December 2014, we conducted special research and research projects and completed the relevant research reports, forming a legislative outline. In January 2015 ~2016, June, the draft law will be drafted and completed, and the draft law will be submitted to the Standing Committee of the National People's Congress for consideration during the current term.

The first category of legislative items refers to the legislative items that are relatively mature and intended to be deliberated in the tenure of office. The second category includes legislative items that need to be considered urgently when work is ripe and when the conditions are ripe. The third category refers to the legislative items that are not fully equipped with legislative conditions and need further research and demonstration by the parties concerned.
This means that the e-business law is still several years away from the real introduction. In response, Zhang Weihua, Secretary of the National People's Congress and party secretary of the Shanghai branch of China Telecom, told the International Commercial Daily reporter: "the scale of China's e-commerce market has reached 10 trillion yuan in 2013, and it is expected to reach 18 trillion yuan by 2015. The process of electronic commerce legislation is still relatively backward compared with the scale of China's electronic business."
Zhang Weihua gave the reporter an example of South Korea's e-commerce legislation: "as early as 1999, when the scale of the e-commerce market in Korea was very small, the framework law of the electronic commerce in Korea had been promulgated, and in order to adapt to the rapid development of e-commerce in the country, the law was amended in 2002."
Zhang Weihua said that his motion on speeding up the legislation of e-commerce law has been seconded by 30 NPC deputies and has been submitted to the National People's Congress. He hopes to "make the electronic commerce law a key legislative item and suggest that the relevant problems should be established in an ultra regular timetable to promote the development of e-commerce."
Multi policy proposals for electricity supplier blueprint
Zhang Weihua revealed to the International Business Daily reporter the basic content of the electronic commerce law contained in the motion: "suggestions include the scope of application of the law, the protection of consumers' rights and interests, the effectiveness of electronic documents, market supervision, data statistics and other major problems facing China's e-commerce."
Zhang Peidong talked about the necessity of legislation for electric business. He pointed out that "e-commerce is the realization of traditional business activities on the Internet, so many laws, regulations and systems are applicable to the Internet, but there are still some areas that can not be covered." For example, she said, such as the emergence of search engines, social media marketing, third party payment and so on. In addition, there are some new legal relationships, such as the relationship between the third party payment and buyers and sellers, the relationship between merchants and platforms.
Other representatives also raised expectations for the construction of e-commerce legal system.
Gao Dekang, chairman of the National People's Congress and chairman of Bosideng group, submitted a proposal on strengthening the protection of intellectual property rights of e-commerce platforms, including the hope that the e-commerce platform will conduct a rigorous examination of the contents related to intellectual property rights.
Gao Dekang said that in recent years, the phenomenon of counterfeiting and shoddy goods and infringement of trademark rights has been rampant in the electricity supplier market. Brand enterprise It also hurts consumers' interests. At present, the proportion of intellectual property disputes is the highest among all business disputes. The most typical example is "piracy". Many sellers selling fake and shoddy products use their brands, such as pictures, texts and videos, to mislead consumers.
Jing Xinhai, chairman of the National People's Congress and chairman of China Construction Software Engineering Limited by Share Ltd, suggested that we should speed up the study of network security legislation and formulate relevant laws on tax collection and administration of e-commerce, so as to ensure the stability of the market and taxation.
Jingxin Hai suggested that a network security legal system should be formed, and the legal system and rules should be refined to enhance operability. Taking personal information protection as the focus of network security legislation, we should set up laws and regulations such as constitution, telecommunication regulations, confidentiality law, improve the protection of personal information collection, possession, processing and use, and study and formulate a legal system for personal information protection with the core of personal information protection law. We should formulate relevant laws and regulations on tax collection and administration of e-commerce, and improve the legal system of Taxation so as to ensure the stability of the market and taxation.
