Domestic Sports Shoes Marked Nike Trademark

Auchan sells two brands of sports shoes produced by two domestic shoe companies, which are marked with the graphic trademark of "flying trapeze Jordan shoes", which is a registered trademark of Nike International Ltd.

On the grounds of infringing its trademark rights, Nike has sent Ou Shang supermarket and the two shoe companies to the second intermediate court of the city.

The court decided to compensate the company for 160 thousand yuan.

Auchan refused to accept the appeal.

In the second instance, the supermarket reached a settlement agreement with Nike recently and withdrew its appeal, and made a positive response to the judicial proposal issued by the second middle court.

In August last year, Auchan supermarket sold its own brand sports shoes made by Jinjiang Long Zhi step Shoes Co., Ltd. and Jinjiang Conway Shoes Co., Ltd. in Shanghai and Ningbo branches, with the logo of "flying trapeze Jordan shoes", which is a trademark of Nike company.

Nike considers that it infringes its trademark right and lodge a lawsuit with the second intermediate court of the city, demanding to stop infringement and make compensation.

The second middle court of Shanghai city made a judgment on the two cases of trademark infringement disputes, and the sales of Auchan supermarket as a seller were judged to be 160 thousand yuan for failing to fulfill the reasonable examination obligation.

After the verdict, Auchan supermarket refused to accept the appeal to the municipal high court.

In the second instance, Auchan supermarket reached a settlement agreement with Nike and withdrew its appeal on the premise of recognition of infringement.

The second middle court of the city issued a judicial suggestion to the company for its infringement on the famous brand merchandise because of its neglect of the examination of the well-known brand merchandise, and asked the company to raise its awareness of intellectual property protection.

A few days ago, Auchan supermarket responded positively to the judicial recommendations of the second middle school, and indicated that measures have been taken: strengthening education and training for employees, further enhancing the awareness of intellectual property rights protection; strictly checking the quality procedures of purchased goods, the company's purchasing department has conducted a comprehensive review of all trademarks concerning goods sold; further improved the management system, and classified intellectual property protection as an important part of enterprise management.
